"Bellbird Creative" shall mean Travis Wayne Draper T/A Bellbird Creative (ABN 18 807 041 025) and Bellbird Creative's successors and assigns.
The purchaser (or any other individual or entity accessing Bellbird Creative's website) acknowledges that all MP3's available through Bellbird Creative's website (www.AudioToursAustralia.com) are the intellectual property of Bellbird Creative, therefore the purchaser (or any other individual or entity accessing Bellbird Creative's website) agrees that they shall not in any way sell, reproduce, adapt, distribute, transmit, or publish the whole or any part of Bellbird Creative's MP3's nor shall they be entitled to create any derivative works using the content of those MP3's.
The purchaser acknowledges that Bellbird Creative's MP3's are a walking tour guide only and were compiled based on routes that were able to be walked at the time the MP3 was created. As the ability to walk any particular route can be influenced by many external factors (including, but not limited to, civil works, weather, accidents or protest action) Bellbird Creative offers no guarantee that all or any part of a walking tour route will be able to be walked at any particular time, nor shall Bellbird Creative have any liability whatsoever to the purchaser where due to circumstances beyond the control of Bellbird Creative the purchaser is unable to complete all or any part of a walking tour.
Whilst Bellbird Creative shall endeavour to keep all information as current as reasonably possible the purchaser acknowledges that information given as part of a walking tour (e.g. whether a museum entry fee is free or not) is indicative and only a guideline and may be subject to change. Bellbird Creative shall have no liability to the purchaser whatsoever where such information subsequently becomes incorrect.
Bellbird Creative's walking tours are designed to be suitable for all persons in reasonable health prior to commencing the tour. The purchaser acknowledges that it shall be their responsibility to ensure their own personal health and safety when undertaking any of Bellbird Creative's walking tours. Bellbird Creative shall not accept any liability whatsoever for any personal injury, or illness (including death) suffered by any person undertaking one of its walking tours.
The purchaser acknowledges that they shall not under any circumstances be entitled to share their login information with any third party and that doing so shall be considered a serious breach of these terms and conditions of trade.
Violation of the terms of trade herein will result in the immediate termination of the user's account (including access to files already paid for) with no prior warning and no refund(s), furthermore where deemed necessary by Bellbird Creative legal proceedings will be commenced.
Bellbird Creative's website may on occasion be temporarily unavailable for reasons of maintenance or due to other circumstances beyond the control of Bellbird Creative (such as, but not limited to, power outages). Bellbird Creative shall not have any liability to the purchaser where such downtime occurs.
Tour prices at www.AudioToursAustralia.com and at other online stores such as iTunes may vary. Pricing external to www.AudioToursAustralia.com is entirely at the discretion of the stores selling Bellbird Creative's products and is not controlled, influenced or regulated in any way by Bellbird Creative.
Bellbird Creative undertakes to give a purchaser at least thirty (30) days notice of any intention to permanently shut down its website.
